ORDINANCE NO. 95-26 (as amended) INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH CHUCK PRICE'S BURTON FORD WITHOUT THE NECESSITY OF ADVERTISEMENT AND FORMAL BIDDING FOR AN AMOUNT NOT TO EXCEED FIFTY FIVE THOUSAND FIVE HUNDRED DOLLARS ($55,500.00). WHEREAS, Council had previously authorized the purchase of three police cars through the State Purchasing Program, and the orders were submitted, only to find out some time later that the manufacturer could not meet the Statewide demand; and WHEREAS, the police vehicles are deteriorated and in need of immediate replacement; and WHEREAS, Section 735.051 of the Ohio Revised Code provides that in the case of a real and present emergency arising in connection with the maintenance and operation of any municipal department, the legislative authority may, by two-thirds (2/3) vote of all its members elected thereto, authorize the Mayor to enter into a contract for the immediate improvement of public property without formal bidding and advertising; and WHEREAS, it has been deemed a real and present emergency to purchase three new police cars in the Village of Mayfield without the necessity of formal advertisement and bidding; and WHEREAS, it is the intent of Council to authorize the Mayor of the Village to enter into a contract for three new police cars without the necessity of legal advertisement and formal bidding, in order to immediately protect the Village and to prevent a threat to the health, safety and welfare of the Village residents, which will occur if same are not immediately purchased. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into a contract for the emergency purchase of three 1995 White Crown Victoria police cars from Chuck Price's Burton Ford pursuant to the quote which is attached hereto and incorporated herein as Exhibit "A". The Mayor is authorized to enter into such an agreement without advertising and formal bidding and that the same is necessitated by a real and .present emergency. SECTION 2. Said purchase of the new police cars is hereby authorized for an amount not to exceed Fifty Five Thousand Five Hundred Dollars ($55,500.00) and that the Director of Finance is hereby authorized and directed to make such payment out of the appropriate fund of the Village.
