ORDINANCE NO. 95-32 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING A CONTRACT WITH RAY'S CEMENT, INC. <br />AS AND FOR CONCRETE AND ASPHALT STREET REPAIRS <br />WHEREAS, the Village has advertised pursuant to law for <br />asphalt and concrete repair work throughout the Village; and <br />WHEREAS, the lowest and best bid was that of Ray's Cement, <br />Inc. in the amount of One Hundred Twenty Nine Thousand Five Hundred <br />Ninety Five Dollars ($129,595.00). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement upon the terms and <br />specifications previously established with Ray's Cement, Inc. for <br />an amount not to exceed One Hundred Twenty Nine Thousand Five <br />Hundred Ninety Five Dollars ($129,595.00), as and for concrete and <br />asphalt repairs throughout the Village. <br />SECTION 2. The Director of Finance is authorized to make <br />payment in the amount of One Hundred Twenty Nine Thousand Five <br />Hundred Ninety Five Dollars ($129,595.00) out of the appropriate <br />J; <br />account. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof.
