ORDINANCE NO. 95-49, <br />~" INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE TRANSFER OF THE OWNERSHIP OF <br />THE NORTH COUNTY LINE SANITARY SEWER PROJECT FROM <br />THE VILLAGE OF HAYFIELD TO CUYAHOGA COUNTY, AND <br />REQUESTING THE DISTRICT ONE INTEGRATING COMMITTEE <br />TO ASSIGN THE PROJECT AND THE CORRESPONDING GRANTS <br />AND LOANS FROM THE VILLAGE OF HAYFIELD TO CUYAHOGA COUNTY <br />WHEREAS, it has been determined that the North County Line <br />Sanitary Sewer Project is a County project; and <br />WHEREAS, as a result of same being a County project, all <br />grants and loans relevant thereto should be coordinated through the <br />Cuyahoga County administration. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That it is hereby and herein determined that the <br />ownership of the project known as the North County Line Sanitary <br />Sewer Project shall be and is hereby transferred from the Village <br />of Mayfield to Cuyahoga County. <br />SECTION 2. That the District One Integrating Committee is <br />hereby and herein requested to assign the project ownership and the <br />corresponding grants and loans from the Village of Mayfield to <br />Cuyahoga County. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />MARK FIX R <br />Council President <br />
