ORDINANCE NO. 95- 52 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING SECTION 509.03(b)(6) RELATIVE TO <br />RESTRICTIONS ON THE LOADING AND UNLOADING <br />OF VEHICLES <br />WHEREAS, it is the recommendation of Council to amend the <br />current disorderly conduct and disturbing the peace sections of the <br />Codified Ordinances to prohibit the loading and unloading of any <br />vehicles in a retail, commercial or industrial location that is <br />within three hundred (300) feet of a residential district between <br />certain hours. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION. 1. That Section 509.03(b)(6) is hereby and herein <br />amended to read as follows: <br />509.0.3 DISORDERLY CONDUCT, INTOXICATION. <br />~ ~ <br />(b) The following acts, among others, are declared to be <br />loud, disturbing or unnecessary noises, in violation of this <br />section, but such enumeration shall not be deemed to be <br />exclusive: <br />* * ~r <br />(6) Loading and unloading vehicles. The creation <br />of a loud and excessive noise in connection <br />with loading or unloading any vehicle or the <br />opening or destruction of bales, boxes, crates <br />and containers. The loading and unloading of <br />any vehicle at any retail, commercial or <br />industrial premises that is located within <br />and 10 o'clock p.m. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />
