ORDINANCE NO. 95-66 <br />INTRODUCED BY: Council as a Whole <br />AN ORDINANCE <br />PROPOSING AN AMENDMENT TO ARTICLE III, SECTION 12 <br />OF THE CHARTER OF HAYFIELD VILLAGE PERTAINING TO THE <br />MANDATORY REFERRALS TO PLANNING AND ZONING <br />WHEREAS, Article XI of the Village Charter provides for a <br />Charter Review Commission every five years; and <br />WHEREAS, the Charter Review Commission has recommended to <br />Council the amendment as hereinafter stated. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Article III, Section 12 of the Charter of the <br />Village of Mayfield, is hereby and herein amended to read as <br />follows: <br />ARTICLE III <br />THE COUNCIL <br />~c <br />SECTION 12. MANDATORY REFERRAL OF ORDINANCES AND <br />RESOLUTIONS. <br />No public building, street, boulevard, parkway, <br />park playground, bridge, tunnel, publicly or privately <br />owned utility or part thereof shall be constructed or <br />authorized to be constructed in the Municipality, nor <br />shall any street, avenue, parkway, boulevard or alley be <br />opened for any purpose whatsoever, nor shall any street, <br />avenue, parkway, boulevard or alley be widened, narrowed, <br />relocated, vacated, or its use changed, nor shall any <br />ordinance referring to zoning or other regulations <br />controlling the use or development of land or changing <br />the existing zoning or use of land, be adopted unless and <br />until it shall have been submitted to the Planning and <br />Zoning Commission for report and recommendation. Any <br />matter so referred to the Planning and Zoning Commission <br />shall be acted upon by it within ninety (90) days from <br />the date of referral unless a different period of time ~e <br />is mutually agreed upon between <br />Council and the Commission. If the Planning and Zoning <br />Commission shall fail to act within the time allotted, it <br />shall be deemed to have approved such matter. Any <br />resolution, ordinance or order disapproved by formal <br />action of the Planning and ..Zoning Commission shall <br />require a vote of two-third of the members of the <br />Council. <br />~ ~ ~ <br />
