ORDINANCE NO. 95-69 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT WITH POWER FONE, INC. <br />RELATIVE TO A COMMUNICATIONS TOWER <br />WHEREAS, Power Fone, Inc. , as known as Nextel, has proposed to <br />construct a new communication tower near the new fire station and <br />to remove the old tower at the discretion of the Village, and to <br />allow the Village to use said tower for its safety communications; <br />and <br />WHEREAS, Power Fone, Inc. has also proposed to lease <br />approximately Two Hundred (200) square feet from the new fire <br />station; and <br />WHEREAS, the construction of the tower will save the Village <br />over One Hundred Thousand Dollars ($100,000.00), and provide a <br />better communications system for our safety forces. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into the lease and construction agreement, <br />attached hereto and incorporated herein as Exhibit "A" with Power <br />Fone, Inc. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance.. is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof.
