ORDINANCE N0. 95-71 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />WITH AUTOMOTIVE RESOURCES, INC. FOR THE PURCHASE <br />OF AUTOMOTIVE LIFTS FOR USE BY THE VILLAGE <br />FIRE DEPARTMENT WITHOUT THE NECESSITY OF <br />ADVERTISEMENT AND FORMAL BIDDING <br />WHEREAS, Section 735.01 of the Ohio Revised Code provides that <br />in the case of a real and present emergency arising in connection <br />with the maintenance and operation of any municipal department, the <br />legislative authority may, by 2/3 vote of all of its members <br />elected thereto, authorize the Mayor to enter into a contract <br />without formal bidding and advertising; and <br />WHEREAS, the Village Council deems it necessary and in the <br />best interest of the health, safety and welfare of all Village <br />residents to purchase heavy duty automotive lift equipment for <br />installation in the new Village Fire Station for use by that <br />Department; and <br />WHEREAS, the Village Fire Chief has been provided an offer for <br />the sale of this lift equipment at GSA prices on an emergency <br />basis; and <br />WHEREAS, there is a real and present emergency due to the fact <br />that the lift equipment is needed for immediate installation within <br />the new Village Fire Station; and <br />WHEREAS, the Village Council wishes to authorize the purchase <br />of this lift equipment. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is authorized and directed to enter <br />into a contract with Automotive Resources, Inc. for the purchase of <br />automotive lift equipment for installation and use in the Mayfield <br />Village Fire Department in an amount not to exceed Thirty Three <br />Thousand Four Hundred Dollars ($33,400.00). Further, the Mayor is <br />authorized to enter into this agreement without advertising and <br />formal bidding since this purchase is necessitated by a real and <br />present emergency which will serve the best interest of all of the <br />Village residents. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />-- requirements of Section 121.22 of the Ohio Revised Code. <br />
