ORDINANCE NO. 95-75 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH CLASSIC CHEVROLET FOR A 1996 PICKUP TRUCK WITHOUT THE NECESSITY OF ADVERTISEMENT AND FORMAL BIDDING FOR AN AMOUNT NOT TO EXCEED TWENTY-FOUR THOUSAND FIVE HUNDRED DOLLARS ($24,500.00) WHEREAS, Section 735.051 of the Ohio Revised Code provides that in the case of a real and present emergency arising in connection with the maintenance and operation of any municipal department, the legislative authority may, by two-thirds (2/3) vote of all its members elected thereto, authorize the Mayor to enter into a contract for the immediate improvement of public property without formal bidding and advertising; and WHEREAS, it has been deemed a real and present emergency to purchase a 1996 Pickup Truck from Classic Chevrolet in the Village of Mayfield without the necessity of formal advertisement and bidding; and WHEREAS, it is the intent of Council to authorize the Mayor of the Village to enter into a contract for this pickup truck without the necessity of legal advertisement and formal bidding, in order to immediately protect the Village and to prevent a threat to the health, safety and welfare of the Village residents, for the maintenance repair of streets and snow plowing which will occur if this truck is not purchased. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into a contract for the emergency purchase of a 1996 Pickup Truck from Classic Chevrolet pursuant to the quote which is attached hereto and incorporated herein as Exhibit "A". The Mayor is authorized to enter into such an agreement without advertising and formal bidding and that the same is necessitated by a real and present emergency. SECTION 2. Said purchase of the 1996 Pickup Truck is hereby authorized for an amount not to exceed Twenty-Four Thousand Five Hundred Dollars ($24,500.00) and that the Director of Finance is hereby authorized and directed to make such payment out of the appropriate fund of the Village. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal .action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
