ORDINANCE NO. 95-7( <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER <br />INTO A CONTRACT WITH ABELE-DAVIS CORP. WITHOUT THE <br />NECESSITY OF ADVERTISEMENT AND FORMAL BIDDING FOR AN <br />AMOUNT NOT TO EXCEED THIRTEEN THOUSAND TWO HUNDRED FORTY <br />THREE DOLLARS ($13,243.00) <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides <br />that in the case of a real and present emergency arising in <br />connection with the maintenance and operation of any municipal <br />department, the legislative authority may, by two-thirds (2/3) vote <br />of all its members elected thereto, authorize the Mayor to enter <br />into a contract for the immediate improvement of public property <br />without formal bidding and advertising; and <br />WHEREAS, it has been deemed a real and present emergency to <br />purchase twenty-seven Beretta 40 Cal. Centurion Pistols in the <br />Village of Mayfield without the necessity of formal advertisement <br />and bidding; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of <br />the Village to enter into a contract for 27 Beretta 40 Cal. <br />Centurion Pistols without the necessity of legal advertisement and <br />formal bidding, in order to immediately protect the Village and to <br />prevent a threat to the health, safety and welfare of the Village <br />residents, which will assist the Police Department in that <br />protection; and <br />WHEREAS, Abele-Davis Corp. will accept the trade in of <br />current weapons owned by the Village and give the Village a credit <br />of $6,284.00 for Departmental weapons, and $1,565.00 credit for <br />confiscated weapons, leaving a net purchase price of $6,394.00. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into a contract for the emergency purchase of 27 <br />Beretta 40 Cal. Centurion Pistols from Abele-Davis Corp. pursuant <br />to the quote which is attached hereto and incorporated herein as <br />Exhibit "A". The Mayor is authorized to enter into such an <br />agreement without advertising and formal bidding and that the same <br />is necessitated by a real and present emergency. <br />SECTION 2. Said purchase of the 27 Beretta 40 Cal. Centurion <br />Pistols is hereby authorized for an amount not to exceed Thirteen <br />Thousand Two Hundred Forty Three Dollars ($13,243.00) and that the <br />Director of Finance is hereby authorized and directed to make such <br />payment out of the appropriate fund of the Village. <br />
