RESOLUTION NO. 94-35 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING A CONTRACT WITH EDP CONSULTANTS, INC. <br />AS AND FOR THE WETLAND MITIGATION PROPOSAL FOR THE <br />UPPER FORTY DRAINAGE IMPROVEMENT AREA <br />WHEREAS, the Engineer has recommended the necessity for a <br />wetland mitigation study to be performed on the Upper Forty <br />Drainage Improvement Area; and <br />WHEREAS, Council has investigated, and the Engineer recommends <br />that the contract for such an investigation and study be performed <br />by EDP Consultants, Inc., said proposal being attached hereto and <br />incorporated herein as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement with EDP Consultants, Inc. in <br />the form and upon the terms and conditions set forth in Exhibit "A" <br />attached hereto and incorporated herein by reference. <br />SECTION 2. The Director of Finance is authorized to make <br />payment for said contract in an amount not to exceed Ten Thousand <br />Dollars ($10,000.00), without further approval of Council. <br />SECTION 3. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of -the <br />health, safety and welfare of the residents of Mayfield Village. <br />It shall, therefore, take effect imr:tediately upon passage by the <br />affirmative vote of not less than `five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />&cil E CINCO, <br />President <br />First Reading: September 19 , 1994 <br />Second Reading: Suspended , 1994 <br />Third Reading: Suspended , 1994
