?? \e -K. y. - I & <br />f <br />ORDINANCE NO. 94- 25 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN ADDITIONAL FIVE THOUSAND <br />DOLLARS ($5,000.00) FOR THE SOM/HIGHLAND <br />INTERSECTION IMPROVEMENT <br />WHEREAS, it is the; intention of Council to expedite the <br />improvement to the SOM/Highland intersection so as to lessen the <br />time period of inconvenience to our residents; and <br />WHEREAS, the contractor performing the improvement has <br />indicated that the job may be capable of being expedited if <br />additional funds were available for overtime at certain times <br />during the project; and <br />WHEREAS, it is the desire of Council to authorize the Mayor to <br />spend an additional amount of money for expediting the project when <br />appropriate, in an amount not to exceed Five Thousand Dollars <br />($5,000.00). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized'to <br />determine when and if certain additions to the project, or <br />overtime, would help facilitate a more expeditious completion of <br />the SOM/Highland intersection improvement. Upon the Mayor making <br />a determination that the project can be advanced more <br />expeditiously, he is hereby and herein authorized to expend a sum <br />not to exceed Five Thousand Dollars ($5,000.00) through the course <br />of the project for such additional work or overtime that may assist <br />in a more speedy completion of the project. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law.
