ORDINANCE NO. 94-37 ' INTRODUCED BY: Mayor Rinker and Council as a Whole AN IIMERGENCY ORDINANCE AUTHORIZING THE PURCHASE OF A CHEVROLET PICKUP FROM CLASSIC CFEVROLET WHEREAS, the Service Department of the Village of Mayfield has been presented with a real and present emergency by the loss of certain vehicles necessary for the daily operation of the Department; and WHEREAS, to postpone the purchase of the needed pickup truck for the time period necessary for public bidding will cause a real threat to the health, safety and welfare of residents in this community; and WHEREAS, Classic Chevrolet has a 1995 pickup truck available, and is willing to pay to the Village Seven Thousand Five Hundred Dollars ($7,500.00) as and for the trade-in of an existing truck no longer suitable or capable of ineeting the needs of the Village of Mayfield; and WFIEREAS, it is the desire of Council to authorize the Purchase of the Classic Chevrolet 1995 pickup pursuant to certain specifications of the Service Director, for a purchase price of Twenty-One Thousand Five Hundred Eighty-Eight and 80/100 Dollars ($21,588.80), less a trade in a Village owned truck in the amount of Seven Thousand Five Hundred Dollars ($7,500.00) for a total payment to Classic Chevrolet of Fourteen Thousand, Eighty-Eight and 80/100 Dollars ($14,088.80); and WHEREAS, Section 735.051 of the Ohio Revised Code provides that in the case of a real and present emergency arising in connection with • the maintenance and operation of any municipal department, the legislative authority may, by two-thirds (2/3) vote of all its members elected thereto, authorize the Mayor to enter into a contract without formal bidding and advertising; and WHEREAS, it has been deemed a real and present emergency to purchase the pickuptruck for the continuing operation of the Service Department in the Village of Mayfield without the necessity of formal bidding and advertising; and WHEREAS, it is the intent of Council to authorize the Mayor of the Village to enter into a contract for the pickup truck without the necessity of legal advertisement and formal bidding, in order to immediately protect the Village and to prevent a threat to the health, safety and welfare of the Village residents, which will occur if there is a delay in the awarding of this contract. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into an agreement with Classic Chevrolet as and for the purchase of a Chevrolet Pickup Truck, and to trade in an existing Village vehicle for a net purchase price of Fourteen Thousand Eighty- Eight and 80/100 Dollars ($14,088.80) The Mayor is authorized to enter into such an agreement without advertising and formal bidding and that the same is necessitated by a real and present emergency. SECTION 2. Said contract is hereby authorized for this amount and -? the Director of Finance is hereby and herein authorized and directed to .-r make such payment out of the appropriate fund of the Village.
