ORDINANCE NO. 94-37 <br />' INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN IIMERGENCY ORDINANCE <br />AUTHORIZING THE PURCHASE OF A CHEVROLET PICKUP <br />FROM CLASSIC CFEVROLET <br />WHEREAS, the Service Department of the Village of Mayfield has been <br />presented with a real and present emergency by the loss of certain <br />vehicles necessary for the daily operation of the Department; and <br />WHEREAS, to postpone the purchase of the needed pickup truck for <br />the time period necessary for public bidding will cause a real threat <br />to the health, safety and welfare of residents in this community; and <br />WHEREAS, Classic Chevrolet has a 1995 pickup truck available, and <br />is willing to pay to the Village Seven Thousand Five Hundred Dollars <br />($7,500.00) as and for the trade-in of an existing truck no longer <br />suitable or capable of ineeting the needs of the Village of Mayfield; and <br />WFIEREAS, it is the desire of Council to authorize the Purchase of <br />the Classic Chevrolet 1995 pickup pursuant to certain specifications of <br />the Service Director, for a purchase price of Twenty-One Thousand Five <br />Hundred Eighty-Eight and 80/100 Dollars ($21,588.80), less a trade in <br />a Village owned truck in the amount of Seven Thousand Five Hundred <br />Dollars ($7,500.00) for a total payment to Classic Chevrolet of Fourteen <br />Thousand, Eighty-Eight and 80/100 Dollars ($14,088.80); and <br />WHEREAS, Section 735.051 of the Ohio Revised Code provides that <br />in the case of a real and present emergency arising in connection with <br />• the maintenance and operation of any municipal department, the <br />legislative authority may, by two-thirds (2/3) vote of all its members <br />elected thereto, authorize the Mayor to enter into a contract without <br />formal bidding and advertising; and <br />WHEREAS, it has been deemed a real and present emergency to <br />purchase the pickuptruck for the continuing operation of the Service <br />Department in the Village of Mayfield without the necessity of formal <br />bidding and advertising; and <br />WHEREAS, it is the intent of Council to authorize the Mayor of the <br />Village to enter into a contract for the pickup truck without the <br />necessity of legal advertisement and formal bidding, in order to <br />immediately protect the Village and to prevent a threat to the health, <br />safety and welfare of the Village residents, which will occur if there <br />is a delay in the awarding of this contract. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement with Classic Chevrolet as and for <br />the purchase of a Chevrolet Pickup Truck, and to trade in an existing <br />Village vehicle for a net purchase price of Fourteen Thousand Eighty- <br />Eight and 80/100 Dollars ($14,088.80) The Mayor is authorized to enter <br />into such an agreement without advertising and formal bidding and that <br />the same is necessitated by a real and present emergency. <br />SECTION 2. Said contract is hereby authorized for this amount and <br />-? the Director of Finance is hereby and herein authorized and directed to <br />.-r make such payment out of the appropriate fund of the Village.
