ORDINANCE NO. 94-57 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT WITH THE FRATERNAL <br />ORDER OF POLICE, LODGE NO. 57, MAYFIELD VILLAGE <br />DIVISION, RELATIVE TO TERMS AND CONDITIONS FOR <br />EMPLOYMENT FROM JANUARY 1, 1994, THROUGH DECEMBER 31, 1996 <br />WHEREAS, the Administration has negotiated for several months <br />the terms and conditions of employment of inembers of the Fraternal <br />Order of Police, Lodge No. 57, Mayfield Village division, for the <br />years effective January 1, 1994, through December 31, 1996, same <br />being attached hereto and incorporated herein as Exhibit "A"; and <br />WHEREAS, Council has reviewed the contract as negotiated by <br />the FOP and the administration, and by reason of this ordinance is <br />ratifying same with the exception of Articles 32, 33 and 34. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into an agreement with the Fraternal Order of <br />Police, Lodge No. 57, Mayfield Village division, upon the terms and <br />conditions set forth in Exhibit "A" attached hereto and <br />incorporated herein by reference, and that by reason of this <br />action, said contract is deemed ratified, with the exception of <br />Articles 32, 33 and 34, spoken to hereafter. <br />SECTION 2. Council will further negotiate with the FOP <br />concerning the terms set forth in Articles 32, 33 and 34. Should <br />no agreement be reached on any of these articles prior to January <br />19, 1995, then such remaining undecided Articles will be referred <br />to neutral arbitration for resolution. Any subsequent agreement <br />between the parties concerning these articles will need to be <br />ratified by separate ordinance of Council. <br />SECTION 3. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law.
