ORDINANCE NO. 94-57 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AN AGREEMENT WITH THE FRATERNAL ORDER OF POLICE, LODGE NO. 57, MAYFIELD VILLAGE DIVISION, RELATIVE TO TERMS AND CONDITIONS FOR EMPLOYMENT FROM JANUARY 1, 1994, THROUGH DECEMBER 31, 1996 WHEREAS, the Administration has negotiated for several months the terms and conditions of employment of inembers of the Fraternal Order of Police, Lodge No. 57, Mayfield Village division, for the years effective January 1, 1994, through December 31, 1996, same being attached hereto and incorporated herein as Exhibit "A"; and WHEREAS, Council has reviewed the contract as negotiated by the FOP and the administration, and by reason of this ordinance is ratifying same with the exception of Articles 32, 33 and 34. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into an agreement with the Fraternal Order of Police, Lodge No. 57, Mayfield Village division, upon the terms and conditions set forth in Exhibit "A" attached hereto and incorporated herein by reference, and that by reason of this action, said contract is deemed ratified, with the exception of Articles 32, 33 and 34, spoken to hereafter. SECTION 2. Council will further negotiate with the FOP concerning the terms set forth in Articles 32, 33 and 34. Should no agreement be reached on any of these articles prior to January 19, 1995, then such remaining undecided Articles will be referred to neutral arbitration for resolution. Any subsequent agreement between the parties concerning these articles will need to be ratified by separate ordinance of Council. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, and for the further reasons set forth in the preamble hereof. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
