- ORDINANCE NO. 93- 39 _. INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF A PROPOSED AMENDMENT TO THE CHARTER WHEREAS, Ohio Constitution Article XVIII, Sections 8 and 9, and Article X of the Charter of the Village of Mayfield, provide that Council shall, upon submission of a petition signed by ten percent (10%) of the registered electors of the Village, provide forthwith for submission of a proposed Charter amendment to the electors at the next general election; and WHEREAS, the Clerk of Council has received a petition for submission of a proposed amendment to the Charter that Section 18 of Article III, Wages, Terms and Conditions of Employment be added to the Charter of the Village of Mayfield requiring Council to adhere to the provisions set forth in' Chapter 4117 of the Ohio Revised Code in providing for the terms and conditions of employment for all departments within the Village having ten (10) or more full time employees; and WHEREAS, it has been determined by the Clerk that the petition has been signed by more than ten percent (10%) of the number of registered electors, and is otherwise valid under the law. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the proposed amendment that Section 18 of Article III, Wages, Terms, and Conditions of Employment be added to the Charter of the Village of Mayfield, requiring Council to adhere to the provisions set forth in Chapter 4117 of the Ohio Revised Code in providing for the terms and conditions of employment for all departments in the Village having ten (10) or more full time employees, shall be submitted to the electors of the Village at the next general election to be held on November 2, 1993. SECTION 2. That the Clerk is authorized and instructed to forward forthwith a certified copy of this Ordinance to the Board of Elections no later than sixty (60) days prior to the November 2, 1993 election. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
