RESOLUTION NO. 92- Zg <br />INTRODUCED BY: Mayor Pietrafese and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />URGING CONGRESS TO DELAY THE STORM <br />WATER MANDATES FOR COMMUNITIES WITH <br />POPULATIONS OF LESS THAN ONE HUNDRED THOUSAND <br />WHEREAS, the National League of Cities has been attempting to <br />get Congress to stop or at least reduce the storm water mandates <br />before they go into effect in October of 1992; and <br />WHEREAS, unless Congress acts promptly, our Village may be <br />required to obtain a permit for every outfall conveying rain water <br />run off, and to meet numerical effluent limits, which are <br />impossible even for our nation's larger cities; and <br />WHEREAS, given the projected costs of the storm water <br />management program to our nation's cities and towns, and <br />particularly to the Village of Mayfield, it is Council's belief <br />that significant changes must be made in order to avoid bankrupting <br />our municipality; and <br />WHEREAS, the limits currently proposed for storm water <br />management are unrealistic, and outrageously costly in terms of the <br />benefits derived from implementation of such requirements. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor and Council on behalf of the <br />residents and businesses of the Village of Mayfield do hereby and <br />herein implore our representatives in the Congress of the United <br />States to oppose or delay the storm water mandates before they go <br />into effect on October 1, 1992. <br />SECTION 2. The Clerk of Council is directed to certify a copy <br />of this resolution to our Congressional representative from this <br />District and to our United States Senators. <br />SECTION 3. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that such plan was necessary to encourage orderly <br />development in Mayfield Village. It shall, therefore, take effect <br />immediately upon passage by the affirmative vote of not less than
