RESOLUTION NOo 92-46 INTRODUCED BY: Mayor Pietrafese and Council as a Whole AN EMERGENCY RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH MAYSOM LIMITED PARTNERSHIP AND CLARKWOOD PROPERTIES AS INDICATED IN AN AGREEMENT LETTER OF NOVEMBER 23, 1992, AND AS AMENDED TO MARCH 1, 1993, INCLUDING LANGUAGE CONCERNING ASSIGNMENT OF PROPERTY. WHEREAS, Village Council presently has pending Ordinance No. 92-34, which addresses the rezoning of certain properties owned by Maysom Limited Partnership and Clarkwood Properties; and WHEREAS, Village Council and Maysom Limited Partnership and Clarkwood Properties have entered into an agreement that will enable all of these parties to further discuss the eventual use and zoning of this property and wish to memorialize that agreement in writinge NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into an agreement with Maysom Limited Partnership and Clarkwood Properties, a copy of which is attached hereto and incorporated herein as Exhibit A. SECTION 2. The Council finds and determines that all formal actions of the Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village.
