RESOLUTION NO. 2005-27 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY RESOLUTION SUPPORTING SEWER DISTRICT CONSOLIDATION WHEREAS, Robert C. Klaiber, Jr., P.E., P.S. Cuyahoga County Engineer has proposed an agreement with the Village that would consolidate Sanitary District 21 (Mayfield Village) with a Sanitary District known as District 3; and WHEREAS, the Cuyahoga County Sanitary Engineer has requested an indication of the Village's intent expressing the Village's interest in considering an agreement to participate in District 3 subject to further review of the agreement by Village Council, the Safety and Service Committee, and any other department head required. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Village Council authorizes the Mayor to enter into negotiations with the Cuyahoga County Sanitary Engineer that would consolidate Sanitary Sewer District 21 (Mayfield Village) into Sanitary Sewer District 3. The agreement will establish an initial annual rate of $3.30 per lineal foot of front footage that will be assessed on the property owner's real estate taxes for tax year 2006, $3.40 for tax year 2007, and $3.50 for tax year 2008. This rate will be for full service by the Cuyahoga County Sanitary Engineer including maintenance and repairs. The agreement will also include the acquisition of the existing Woodbran Sewage Treatment Facility by the Cuyahoga County Sanitary Engineer. The plant will be converted to a pump station and the sewage currently treated by the Woodbran plant will then be treated by the Northeast Ohio Regional Sewer District's Southerly Wastewater Treatment Plant. The Northeast Ohio Regional Sewer District will bill its customers directly for sewage treatment. The annual rate may be adjusted in the future but the Village's rate will not exceed the rate established for other communities in the Cuyahoga County Sanitary Engineer District 3 that receive full service. SECTION 2. The Village requests that the Cuyahoga County Sanitary Engineer forward an agreement to the Mayor for review, which will thereafter be reviewed by Council and by the Safety and Service Committee for final consideration, so that the form of the agreement shall be acceptable to the Council.
