RESOLUTION NO. 2005-27 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />SUPPORTING SEWER DISTRICT CONSOLIDATION <br />WHEREAS, Robert C. Klaiber, Jr., P.E., P.S. Cuyahoga County Engineer <br />has proposed an agreement with the Village that would consolidate Sanitary <br />District 21 (Mayfield Village) with a Sanitary District known as District 3; and <br />WHEREAS, the Cuyahoga County Sanitary Engineer has requested an <br />indication of the Village's intent expressing the Village's interest in considering an <br />agreement to participate in District 3 subject to further review of the agreement <br />by Village Council, the Safety and Service Committee, and any other department <br />head required. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF <br />MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Village Council authorizes the Mayor to enter into <br />negotiations with the Cuyahoga County Sanitary Engineer that would consolidate <br />Sanitary Sewer District 21 (Mayfield Village) into Sanitary Sewer District 3. The <br />agreement will establish an initial annual rate of $3.30 per lineal foot of front <br />footage that will be assessed on the property owner's real estate taxes for tax <br />year 2006, $3.40 for tax year 2007, and $3.50 for tax year 2008. This rate will be <br />for full service by the Cuyahoga County Sanitary Engineer including maintenance <br />and repairs. The agreement will also include the acquisition of the existing <br />Woodbran Sewage Treatment Facility by the Cuyahoga County Sanitary <br />Engineer. The plant will be converted to a pump station and the sewage <br />currently treated by the Woodbran plant will then be treated by the Northeast <br />Ohio Regional Sewer District's Southerly Wastewater Treatment Plant. The <br />Northeast Ohio Regional Sewer District will bill its customers directly for sewage <br />treatment. The annual rate may be adjusted in the future but the Village's rate <br />will not exceed the rate established for other communities in the Cuyahoga <br />County Sanitary Engineer District 3 that receive full service. <br />SECTION 2. The Village requests that the Cuyahoga County Sanitary <br />Engineer forward an agreement to the Mayor for review, which will thereafter be <br />reviewed by Council and by the Safety and Service Committee for final <br />consideration, so that the form of the agreement shall be acceptable to the <br />Council. <br />
