ORDINANCE NO. 2005-43 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING CHAPTER 1501 OF THE CODIFIED ORDINANCES OF THE VILLAGE <br />OF MAYFIELD BY ADOPTING NEW SECTION 1501.14 ESTABLISHING <br />PROGRESSIVE FIRE INSPECTION FEES. <br />WHEREAS, the Fire Safety Inspector under the direction and control of the Fire <br />Chief of the Mayfield Village Fire Department is charged with the duty to inspect all <br />nonresidential structures and occupancies within the Village to assure compliance with <br />all applicable fire codes and fire prevention laws; and <br />WHEREAS, upon review and recommendation of the Fire Chief and the Fire <br />Safety Inspector, it is deemed to be in the best interest of the health, safety and welfare <br />of all Village residents to amend Chapter 1501 of the Codified Ordinances of Mayfield <br />Village by adding new Section 1501.14 which will institute a progressive inspection fee <br />schedule which has the purpose of encouraging timely compliance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO: <br />SECTION 1. That Chapter 1501 of the Codified Ordinances of the Village of <br />Mayfield is amended by adopting new Section 1501.14 entitled "FIRE SAFETY <br />INSPECTION FEES" which is attached as Exhibit "A". <br />SECTION 2. That this ordinance shall be applicable to all fire safety inspections <br />undertaken on or after the 1 st day of October, 2005. <br />SECTION 3. That the rest, residue and remainder of all Village ordinances shall <br />remain as presentfy drafted unless inconsistent with this ordinance. <br />SECTION 4. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio <br />Revised Code. <br />SECTION 5. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio.
