RESOLUTION NO. 96- 13 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING AND DIRECTING THE VILLAGE ENGINEER <br />TO PREPARE PLANS, BIDS AND SPECIFICATIONS WITH <br />REGARDS TO THE WILSON MILLS ROAD CORRIDOR TRAFFIC <br />FLOW IMPROVEMENT PROJECT <br />WHEREAS, since it appears that State Issue 2 money may be <br />awarded to Mayfield Village for the Wilson Mills Road Corridor <br />Traffic Flow Improvement Project, and the Village Engineer <br />recommends that the preparation of plans, bids and specifications <br />should be done immediately to allow ample time_for the design and <br />bidding process to be performed in order that this improvement may <br />be completed this year; and <br />WHEREAS, the Village Council deems this necessity for <br />immediate action to be an emergency as set forth in Ohio Revised <br />Code Section 153.71 and wishes to authorize the Village Engineer to <br />immediately prepare plans, bids, and specifications with regards to <br />the Wilson Mills Road Corridor Traffic Flow Improvement Project. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Village Engineer is authorized and <br />directed to immediately prepare plans, bids and specifications with <br />regards to the Wilson Mills Road Corridor Traffic Flow Improvement <br />Proj ect . <br />SECTION 2. That the immediate action necessitated by this <br />project and the availability of State Issue 2 funds is deemed to be <br />an emergency as set forth in Ohio Revised Codes Section 153.71. <br />SECTION 3. The Council finds and determines that all formal <br />actions of the Council relating to the adoption of this Resolution <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in <br />compliance with all ? statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village. <br />It shall, therefore, take effect immediately upon passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />XRK FIXL , <br />Council President
