ORDINANCE NO. 96- 26 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING THE GENERAL OFFENSE SECTION OF THE CODIFIED <br />ORDINANCES OF THE VILLAGE OF MAYFIELD IN ORDER TO <br />COMPLY WITH CURRENT STATE LAW. <br />WHEREAS, Article VIII, Section 3 of the Ohio Constitution <br />requires that the exercise of the municipal police powers not be in <br />conflict with general State law with regards to criminal matters; <br />and <br />WHEREAS, Am. Sub. Senate Bill 2, effective July 1, 1996, has <br />substantially revised Ohio law pertaining to criminal sentencing <br />and certain theft offenses; and <br />WHEREAS, numerous sections with the General Offense Code of <br />the Codified Ordinances of the Village of Mayfield need to be <br />added, amended, or repealed in order to comply with the provisions <br />of Am. Sub. Senate Bill 2. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the General Offense Code section of the <br />Codified Ordinances of the Village of Mayfield are to be <br />supplemented, amended or repealed as indicated in Exhibit "A", <br />attached. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />A K FI r ER <br />Council President
