r <br />ORDINANCE NO. 96- 30 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING SECTION 333.03 OF THE CODIFIED <br />ORDINANCES RELATING TO MAXIMUM SPEED LIMITS <br />ON FREEWAYS LOCATED WITHIN THE <br />VII,LAGE OF MAYFIELD, OHIO. -WI-IEREA.S, the State of Ohio and the Federal Highway Administration <br />has recently increased the speed limit on freeways located within the <br />boundaries of the Village of Mayfield over the objection of the Village <br />Council, the Mayor, and the Chief of Police; and <br />?"?F2FAS' it is now necessary to amend the Traffic Code of the <br />Village of Mayfield to reflect this increase in the speed limit from 55 <br />to 60 mile per hour. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That Section 333.03 (b) (7) of the Codified Ordinances <br />of the Village of Mayfield is amended as follows: <br />333.03 MAXIMUtR SPEED LIMITS; ASSURED CLEAR DISTANCE <br />(a) No person shall operate a motor vehicle at a speed <br />greater or less than is reasonable or proper, having due <br />regard to the traffic, surface, and width of the street <br />or highway, and other conditions, and no person shall <br />drive any motor vehicle in and upon any street or highway at <br />a greater speed than will permit him to bring it to a stop <br />within the assured clear distance ahead. <br />(b) It is prima-facie lawful, in the absence of a lower limit <br />declared pursuant to Ohio R.C. 4511.21 by the Ohio <br />Director of Transportation or Council, for the operator <br />of a motor vehicle to operate the same at a speed not <br />exceeding the following: <br />* * ? <br />(7) Sixtv miles per hour at all times on <br />freeways with paved shoulders inside the <br />Municipality other than freeways as provided in <br />Subsection (b)(8) hereof. <br />?x * * <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance have <br />been taken at open meetings of this Council; and that deliberations of <br />this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all <br />statutory recjuirements including the requirements of Section 121.22 of <br />the Ohio Revised Code.
