ORDINANCE NO. 96-34 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO EIVTER INTO CONTRACTS WITH <br />PIRC LANDSCAPING COo AND SUMMERBREEZE LANDSCAPING, INC. <br />FOR THE PURPOSE OF SNOW REMOVAL <br />WHEREAS, the Village has advertised, pursuant to law, for bids <br />pertaining to the removal of snow from the driveways of senior <br />citizens during the 1996-1997 winter season; and <br />WHEREAS, the Village was divided into three (3) districts, and <br />bidders were invited to bid on one (1), two (2), or all three (3) <br />districts; and <br />WHEREAS, the lowest and best bidders were Pirc Landscaping <br />Co., with a bid of One Hundred Forty Dollars ($140.00) per driveway <br />for two of the districts advertised, and Summerbreeze Landscaping, <br />Inc., with a bid of One Hundred Forty-Eight Dollars ($148.00) per <br />driveway, for one of the districts advertised. <br />NOW, THEREFORE,. BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and <br />directed to enter into agreements with Pirc Landscaping Co., and <br />Summerbreeze Landscaping, Inc. as and for snow removal from the <br />driveways of senior citizens as directed by the Mayor's office and <br />the Director of Service, and pursuant to the advertisement for bids <br />and all bid specifications, and payments to be made pursuant to the <br />specifications as advertised. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, for the reason <br />to encourage commercial development within Mayfield Village. It <br />shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />RK FIXLEV_, <br />"Council President
