ORDINANCE NO. 96-37 <br />INTRODUCED BY: MAYOR BRUCE RINKER AND COUNCIL AS A WHOLE <br />AN ORDINANCE REQUIRING ALL BANKS AND OTHER FINANCIAL <br />INSTITUTIONS IN MAYFIELD VILLAGE PROVIDING ACCESS TO <br />AUTOMATED TELLER MACHINE (ATMs) WHICH ARE LOCATED <br />OUTSIDE OF A BUILDING OR OTHER STRUCTURE TO 1NSTALL <br />SURVEILLANCE CAMERAS, AND HAVE CARD ACTIVATED <br />ACCESS TO 911 AN DECLARING AN EMERGENCY. <br />WHEREAS, the safety and security of all users of Automated Teller Machines in <br />Mayfield Village is a prime concern of the Mayor and members of Council; and <br />WHER$AS, it has been deternuned that the installation of surveillance cameras and <br />card activated 911 access would play an important role in protecting users of Automated Teller <br />Machines in Mayfield Village. , <br />NOW, THEREFORE, BE IT ORDAINED BY THE CQUNCIL OF MAYFIELD <br />VILLAGE, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />Section 1. Requirement Within six months (6) from the date this Ordinance is enacted all <br />banks and other financial institutions in Mayfield Village providing access to an Automated Teller <br />Machine which is located outside of a building or other structure shall have installed and have <br />functioning for the safety of all users of Automated Teller Machines cameras capable of <br />photographing the general area around the ATM as well as the areas of ingress and egress to the <br />ATM. Section 2. Within nine months (9) from the datethis Ordinance is enacted all ATMs <br />located outside of a building or other structure shall be equipped with card activated 911 access. <br />Section 3. The location of the cameras required by this ordinance must be inspected and <br />approved by the Chief of Police or his designated representative. <br />Section 4. Penalt Whoever violates any provision of this Ordinance shall be guilty of a <br />First Degree Misdemeanor. <br />Section 5. That this Ordinance is hereby declared to be an emergency measure dealing <br />with the daily operation of a municipal department, and provided it receives the affirmative vote <br />of two-thirds (2/3) of all members elected to Council; it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in <br />force from and after the earliest period allowed by law.
