ORDINANCE NO. 97- 44 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE ADMINISTRATION TO ENTER INTO AN AGREEMENT WITH GREGORY LAMBRIGHT AS AND FOR THE PURCHASE OF PERMANENT PARCEL NO. 831-05-004, OTHERWISE KNOWN AS 6540 WHITE ROAD, IN THE VILLAGE OF HAYFIELD WHEREAS, the Village of Mayfield is desirous of acquiring the following property as and for an alternative access way to the newly acquired Parkview Golf Course; and WHEREAS, the Village has appraised the property and determined the fair market value to be $114,000.00. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor, Director of Finance, and Director of Law are hereby and herein authorized and directed to enter into a purchase agreement and to acquire the property known as Permanent Parcel No. 831-05-004, and municipally known as 6540 _ White Road, in the Village of Mayfield, for an amount not to exceed $114,000.00, and upon the terms and conditions set forth in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, and for the further reasons that time is of the essence both to act to protect and presence the existing eco-system and with respect to offered acquisition funding. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
