ORDINANCE NO. 97- 44 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE ADMINISTRATION TO ENTER INTO <br />AN AGREEMENT WITH GREGORY LAMBRIGHT <br />AS AND FOR THE PURCHASE OF PERMANENT PARCEL <br />NO. 831-05-004, OTHERWISE KNOWN AS 6540 WHITE ROAD, <br />IN THE VILLAGE OF HAYFIELD <br />WHEREAS, the Village of Mayfield is desirous of acquiring the following property <br />as and for an alternative access way to the newly acquired Parkview Golf Course; and <br />WHEREAS, the Village has appraised the property and determined the fair market <br />value to be $114,000.00. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor, Director of Finance, and Director of Law are hereby <br />and herein authorized and directed to enter into a purchase agreement and to acquire the <br />property known as Permanent Parcel No. 831-05-004, and municipally known as 6540 <br />_ White Road, in the Village of Mayfield, for an amount not to exceed $114,000.00, and <br />upon the terms and conditions set forth in Exhibit "A" attached hereto and incorporated <br />herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons that time is of the essence both to act to protect <br />and presence the existing eco-system and with respect to offered acquisition funding. It <br />shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise at <br />the earliest time allowed by law. <br />
