ORDINANCE NO. 97- 4s <br />~, INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />ADDING NEW CHAPTER 709 TO THE CODIFIED ORDINANCES <br />OF THE VILLAGE OF HAYFIELD RELATING TO THE REGULATION OF THE <br />USE OF VILLAGE RIGHTS-OF-WAY BY TELECOMMUNICATIONS COMPANIES <br />WHEREAS, Council deems it necessary to regulate the use of Village rights-of-way <br />by telecommunication companies desiring to utilize same, in furtherance of the public's <br />peace, health, safety and welfare. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. New Chapter 709 shall be added to the Codified Ordinances of the <br />Village of Mayfield and, as enacted, shall read as follows: <br />CHAPTER 709 <br />Telecommunication Right-of-Way Permits <br />709.01 PERMIT REQUIRED. <br />All persons, firms, partnerships, corporations, limited liability companies, trusts, joint <br />stock companies, unincorporated associations, governmental entities, banking institutions, <br />joint stock companies, and any other organization, wishing to construct, operate, maintain, <br />reconstruct, and/or rebuild a telecommunications network used to provide <br />telecommunications services to residents, businesses or other premises within the Village <br />or through the Village to service other municipalities shall be required to obtain a <br />Telecommunications Right-of-Way Permit from the Building Commissioner in the form and <br />under the requirements provided for in Section 709.02 of this Chapter., <br />709.02 FORM OF PERMIT. <br />The form of the Telecommunications Right-of-Way Permit required under this <br />Chapter shall be in the form as set forth in Exhibit "A", attached hereto and expressly made <br />a part hereof by reference. <br />709.03 AMENDMENT OF PERMIT AFTER GRANT. <br />Any Telecommunications Right-of-Way Permit granted under this Chapter may be <br />amended only in accordance with the provisions contained in the Permit as provided for <br />in Section 709.02 of this Chapter and only upon approval of such amendment by Village <br />Council <br />709.99 PENALTY. <br />Any person, firm, partnership, corporation, limited liability company, joint stock <br />company, unincorporated association, governmental entity, banking institution, joint stock <br />company, or any other person or organization who violates any provision of this Chapter <br />
