0l/22/~0 ORDINANCE N0. 90-3 ' ~ INTRODUCED BY: Mayor Carmen and Council as a Whole AN ORDINANCE AMENDING SECTION 521.12 OF THE CODIFIED ORDINANCE OF HAYFIELD VILLAGE, OHIO TO PROHIBIT REMOVAL OF RECYCLABLE MATERIALS AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Section 521.12 of the Codified Ordinance of Mayfield Village, Ohio, is hereby amended to read as follows: (Deleted material appears like this' and new material appears like THIS) Chapter 521 Health, Safety and Sanitation 521.12 Curbside Garbage Deposits; Regulations (a) Except as herein otherwise provided, no person shall place or deposit on the curb or treelawn any garbage, rubbish or other refuse intended for regular trash pick-up earlier than 6:00 p.m. on the day before such pick-up is scheduled.. Residents shall be permitted to place trash bags containing grass clippings or other yard maintenance refuse on the curb or treelawn for pick-up at any time of the day before such pick-up is scheduled. (b) NO PERSON SHALL REMOVE, APPROPRIATE OR OTHERWISE TAKE ANY GARBAGE, RUBBISH OR OTHER REFUSE DEPOSITED ON OR AROUND TREE LAWNS FOR. COLLECTION BY THE RESIDENTIAL CURBSIDE RECYCLING PROGRAM EXCEPT FOR AUTHORIZED AGENTS OF THE MUNICIPALITY. (C) Whoever violates this section is guilty of a minor misdemeanor. SECTION 2. All prior Ordinances inconsistent with this Ordinance in whole or in part, are repealed to the extent necessary to avoid conflict with this Ordinance. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
