0l/22/~0 <br />ORDINANCE N0. 90-3 <br />' ~ INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />AMENDING SECTION 521.12 OF THE CODIFIED ORDINANCE <br />OF HAYFIELD VILLAGE, OHIO TO PROHIBIT REMOVAL OF <br />RECYCLABLE MATERIALS AND DECLARING <br />AN EMERGENCY <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Section 521.12 of the Codified Ordinance of Mayfield Village, <br />Ohio, is hereby amended to read as follows: (Deleted material appears like <br />this' and new material appears like THIS) <br />Chapter 521 <br />Health, Safety and Sanitation <br />521.12 Curbside Garbage Deposits; Regulations <br />(a) Except as herein otherwise provided, no person shall place or <br />deposit on the curb or treelawn any garbage, rubbish or other refuse intended <br />for regular trash pick-up earlier than 6:00 p.m. on the day before such <br />pick-up is scheduled.. Residents shall be permitted to place trash bags <br />containing grass clippings or other yard maintenance refuse on the curb or <br />treelawn for pick-up at any time of the day before such pick-up is scheduled. <br />(b) NO PERSON SHALL REMOVE, APPROPRIATE OR OTHERWISE TAKE ANY GARBAGE, <br />RUBBISH OR OTHER REFUSE DEPOSITED ON OR AROUND TREE LAWNS FOR. COLLECTION BY <br />THE RESIDENTIAL CURBSIDE RECYCLING PROGRAM EXCEPT FOR AUTHORIZED AGENTS OF THE <br />MUNICIPALITY. <br />(C) Whoever violates this section is guilty of a minor misdemeanor. <br />SECTION 2. All prior Ordinances inconsistent with this Ordinance in <br />whole or in part, are repealed to the extent necessary to avoid conflict with <br />this Ordinance. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
