<br />6/18/90 <br />ORDINANCE N0. 90-28 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />AMENDING SECTION 1113.04(g) OF THE. <br />CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, <br />PERTAINING TO THE DEFINITION OF "SERVICE STATION" <br />TO INCLUDE RETAIL SALE OF PRE-PACKAGED <br />FOODSTUFFS AND SUNDRY ITEMS AND <br />DECLARING AN EMERGENCY <br />WHEREAS, it has come to the attention of Council that certain service <br />stations throughout the country have been expanding their operations to <br />include the sale of foodstuffs and sundry items; and <br />WHEREAS, it is the clear intent of this Council to regulate the operation <br />of service stations to better serve the total. environment of Mayfield Village; <br />and <br />WHEREAS, operating a vehicle while under the influence of alcohol is <br />universally known to present a threat to the public safety; and <br />WHEREAS, permitting service stations which are created to serve the <br />motoring public to sell. alcoholic beverages would fly in the face of reason. <br />and this Council notes that any increase in the opportunity to mix driving <br />with alcoholic beverages should be strongly opposed; and <br />WHEREAS, it is clearly within the public interest to prohibit the sale <br />therein of items which would, if made available for sale, present a clear <br />threat to public safety of any person exposed to operations of vehicles under <br />the influence of alcohol who patronize gas station mini-marts selling alcohol- <br />ic beverages; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Section 113.04(g) of the Codified Ordinances of Mayfield <br />Village is hereby amended pertaining to the definition of "Service Station" to <br />include retail sale of pre-packaged foodstuffs and sundry items so that new <br />Section 1113.04(g) shall read as follows: <br />
