6/25/90 ,~ ORDINANCE N0. 90- 30 INTRODUCED BY: Mayor Carmen and Council as a Whole AN ORDINANCE AMENDING SECTION 1119.16(b) OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO PERTAINING TO THE REQUIRED MAINTENANCE BOND FOR SUBDIVISION IMPROVEMENTS AND DECLARING AN EMERGENCY BE TT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Section 1119.16(b) of the Codified Ordinance of Mayfield Vil- lage, Ohio, is hereby amended by increasing the required maintenance bond for subdivision improvements so that new subsection 1119.16(b) shall read as follows: (Deleted material appears like-~ and new material appears like THIS) Chapter 1119 -~ ~ •~ • Required Improvements 1119.16 CERTIFICATION OF COMPLETION; MAINTENANCE-BOND. (b) Maintenance Bond. The developer shall furnish to the Municipality a maintenance bond in the amount of -f~~--~r~--(~O~r}-~f the TOTAL cost of all improve- ments which have been installed. This bond shall be conditioned on the proper operation of these improve- ments for a period of three (3) years from the date of the granting of the final approval. The bond shall provide that the Municipality shall be held harmless and free of tort and contract claims of third persons, with the right given to the Municipality to effect any necessary repair or correction of these improvements .during such three (3) year period and hold the princi- pal and surety jointly and severally liable on the bond. Before the Municipality exercises its right to effect any necessary repairs or correction to the required improvements during the three (3) year period it shall first give a ten (10) day written notice to the developer of its intention to do so. SECTION 2. All prior Ordinances inconsistent with this Ordinance, in whole or in part, are repealed to the extent necessary to avoid conflict with • this Ordinance.
