6/25/90 <br />,~ ORDINANCE N0. 90- 30 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />AMENDING SECTION 1119.16(b) OF THE <br />CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO <br />PERTAINING TO THE REQUIRED MAINTENANCE <br />BOND FOR SUBDIVISION IMPROVEMENTS AND <br />DECLARING AN EMERGENCY <br />BE TT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Section 1119.16(b) of the Codified Ordinance of Mayfield Vil- <br />lage, Ohio, is hereby amended by increasing the required maintenance bond for <br />subdivision improvements so that new subsection 1119.16(b) shall read as <br />follows: (Deleted material appears like-~ and new material appears like <br />THIS) <br />Chapter 1119 <br />-~ ~ •~ <br />• Required Improvements <br />1119.16 CERTIFICATION OF COMPLETION; MAINTENANCE-BOND. <br />(b) Maintenance Bond. The developer shall furnish to <br />the Municipality a maintenance bond in the amount of <br />-f~~--~r~--(~O~r}-~f the TOTAL cost of all improve- <br />ments which have been installed. This bond shall be <br />conditioned on the proper operation of these improve- <br />ments for a period of three (3) years from the date of <br />the granting of the final approval. The bond shall <br />provide that the Municipality shall be held harmless <br />and free of tort and contract claims of third persons, <br />with the right given to the Municipality to effect any <br />necessary repair or correction of these improvements <br />.during such three (3) year period and hold the princi- <br />pal and surety jointly and severally liable on the <br />bond. Before the Municipality exercises its right to <br />effect any necessary repairs or correction to the <br />required improvements during the three (3) year period <br />it shall first give a ten (10) day written notice to <br />the developer of its intention to do so. <br />SECTION 2. All prior Ordinances inconsistent with this Ordinance, in <br />whole or in part, are repealed to the extent necessary to avoid conflict with <br />• this Ordinance. <br />
