03/19/90
~~~ RESOLUTION N0. 90- 21
INTRODUCED BYc Mayor Carmen and Council as a Whole
A RESOLUTION
URGING SUPPORT FOR THE CITY OF
MIDDLEBURG HEIGHTS IN ITS EFFORT
TO PREVENT PRIVATE DEVELOPERS FROM BUILDING
MULTIFAMILY BUILDINGS WITHOUT ADEQUATE FIRE WALLS
WHEREAS, the City of Middleburg Heights Code requires multifamily build-
ings to have "fire walls" constructed of masonary block to prevent the spread
of fire from unit to unit within a multifamily structure; and
WHEREAS, private developers have persuaded the State Board of Building
Standards that State of Ohio Basic Building Code allows "fire separations"
constructed of wood and dry wall in three story multifamily buildings; and
WHEREAS, private developers contend that it is cheaper to construct
multifamily buildings with a "fire separation" made of wood and dry wall
rather that a "fire wall" constructed of masonry block, while ignoring the
;• fact that actual and potential long term costs of this cheaper construction
_, are greater to the community; and
WHEREAS, the Council and Mayor of Middleburg Heights believe that the
"fire separations" are inadequate to prevent loss of life and economic loss
that would be prevented by "fire walls"; and
WHEREAS, the Ohio Board of Building Standards, a non-elected state board,
has attempted to punish the city of Middleburg Heights by decertifying its
building department because the City of Middleburg Heights requires "fire
walls"; and
WHEREAS, the City of Middleburg Heights has appealed said order to the
Franklin County Common Pleas Court where it is now pending; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THATe
SECTION 1. That the Mayor and Council of Mayfield Village hereby urge
the Ohio State Legislature to pass legislation which would prevent the Board
of Building Standards from interfering with Municipal fire regulations that
protect the citizens from loss of life and/or property.
