RESOLUTION NO. 91-36 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />DECLARING D. C. ~ SON CEMENT & MASONRY, INC. <br />TO BE THE LOWEST AND BEST BIDDER <br />FOR THE REMOVAL AND REPLACEMENT OF CONCRETE SIDEWALKS <br />AT VARIOUS LOCATIONS IN HAYFIELD VILLAGE, <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO EXECUTE A CONTRACT WITH SAID BIDDER, <br />REJECTING ALL OTHER BIDS RECEIVED AND <br />DECLARING AN EMERGENCY <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. In accordance with the bids received pursuant <br />to advertisement as required by law, D. C. & Sons Cement & <br />Masonry, Inc. is hereby declared to be the lowest and best bidder <br />for the removal and replacement of concrete sidewalks at various <br />locations in Mayfield Village. <br />SECTION 2. The Mayor and President of Council is hereby <br />authorized and directed to execute a contract with said bidder in <br />the amount not to exceed Twenty Six Thousand Six Hundred Eighteen <br />Dollars and Sixty-Five Cents ($26,618.65) provided that the same <br />is in accordance with the specifications upon which the bid was <br />received. <br />SECTION 3. All other bids received are hereby rejected. <br />SECTION 4. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 5. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of <br />the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, for the reason that the contract authorized herein <br />is necessary to make the required improvements. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />
