RESOLUTION NO. 91-47 <br />INTRODUCED BY: Mayor Carmen and Mrs. Cinco, Mr. Ferrante, <br />Mrs. Mills, Mr. Pietrafese and Mr. Rinker <br />A RESOLUTION <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO AN AGREEMENT WITH <br />PANZICA CONSTRUCTION AS APPROVED BY THE <br />LAW DIRECTOR FOR CONSTRUCTION MANAGER SERVICES IN CONNECTION <br />WITH THE MUNICIPAL COMPLEX AND <br />DECLARING AN EMERGENCY <br />BE IT RESOLVED BY PART OF THE COUNCIL OF HAYFIELD VILLAGE, OHIO, <br />THAT: <br />SECTION 1. The Mayor and President of Council are hereby <br />authorized and directed to execute a contract with Panzica <br />Construction Company for construction manager services in <br />connection with the Municipal Complex. Before the execution of <br />such agreement, the terms and conditions of such contract must be <br />approved by the Law Director. <br />SECTION 2. The Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 3. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the health, safety <br />and welfare of the residents of Mayfield Village, Ohio, for the <br />reason that it is necessary to implement such agreement for <br />purposes of constructing the Municipal Complex in a timely <br />manner. It shall, therefore, take effect immediately upon the <br />passage by the affirmative vote of not less than five (5) members <br />
