0(11611JFt L. <br />ORDINANCE NO. 91.- 56 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE ENACTING CHAPTER 1375 OF THE CODIFIED <br />ORDIPiANCES OF MAYFIELD VILLAGE, OHIO, PERTAINING <br />TO THE PREVENTION OF FLOOD DAMAGE BY ADOPTING <br />MINIMUM FLOODPLAN MANAGEMENT REQUIREMENTS IN <br />ORDER TO MAINTAIN ELIGIBILITY IN THE NATIONAL <br />FLOOD INSURANCE PROGRAM, REPEALING EXISTING <br />CHAPTER 1375 AND ALL ORDINANCES INCONSISTENT <br />HEREWITH AND DECLARING AN EMERGE1dCY <br />WHEREAS, Article XVIII, Section 3, of the Ohio <br />Constitution grants municipalities the legal authority to adopt <br />land use and control measures for promoting the health, safety. and <br />general welfare of its residents; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT; <br />SECTION 1. There is hereby enacted Chapter 1375 of the <br />Codified Ordinances of Mayfield Village, Ohio, which shall read as <br />follows: <br />Chapter 1375 <br />Flood Damage Prevention <br />1375.01 Factual Basis. <br />(A) The flood hazard areas of Mayfield Village are <br />subject to periodic inundation which may result in loss <br />of life and governmental services, extraordinary public <br />expenditures for flood protection and relief, and <br />impairment of the tax base, all of whieh adversely affect <br />the public health, safety, and general welfare. <br />(B) These flood losses are caused by the cumulative <br />effect of obstructions in areas of special flood hazards <br />which increase flood heights and velocities and, when <br />inadequately anchored, damage uses in other area. Uses <br />that are inadequately flood-proofed, elevated or <br />otherwise protected from flood damage also contribute to <br />the flood loss.
