ORDINANCE N0.2011-27 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />WITH APPLE HEATING & COOLING FOR THE PURCHASE OF <br />TWO (2) CARRIER AIR CONDITIONING UNITS <br />IN AN AMOUNT NOT TO EXCEED $14,000.00 <br />WITHOUT THE NECESSITY OF <br />ADVERTISEMENT AND FORMAL BIDDING <br />WHEREAS, Section 732.05 of the Ohio Revised Code provides that in the case of a real and <br />present emergency, arising in connection with the operation of any municipal department, the <br />legislative authority may, bytwo-thirds vote of all of its members elected thereto, authorize entering <br />into a contract for a purchase without formal bidding and advertising; and <br />WHEREAS, it has been found that a real and present emergency exists for the Village's Civic <br />Center air conditioning units to be replaced in order to protect the integrity of the Civic Center roof <br />and structure which is currently causing water to enter the building resulting in damage thereto; and <br />WHEREAS, in order to prevent further damage to the Civic Center, and due to the existence <br />of this real and present emergency, Village Council has determined that such purchase shall be made <br />from Apple Heating & Cooling for an amount not to exceed $14,000.00 without the need of <br />advertisement and formal bidding. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Council of the Village of Mayfield hereby authorizes the Mayor to <br />enter into a contract with Apple Heating & Cooling for the purchase of two (2) new Carrier five ton <br />rooftop air conditioning units as more fully set forth in the proposal attached hereto and incorporated <br />herein by reference as Exhibit "A" in an amount not to exceed $14,000.00 which has been deemed <br />the best price for such units without advertising and formal bidding due to the existence of a real and <br />present emergency in replacing these units which, if left unattended, will continue to cause water <br />damage to the Civic Center. <br />SECTION 2. The Council finds and determines that all formal actions of this Council relating <br />to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
