ORDINANCE NO. 2011-28 INTRODUCED BY: Mayor Rinker and Council as a Whole AN ORDINANCE REVISING THE ZONE MAP OF HAYFIELD VILLAGE SO AS TO AMEND THE USE CLASSIFICATION OF 1028 ACRES OF LAND LOCATED ON THE SOUTH SIDE OF WILSON MILLS ROAD EAST OF SOM CENTER ROAD AND KNOWN AS PERMANENT PARCEL NUMBERS 831-39-010 AND 831-39-009 FROM ITS CURRENT CLASSIFICATION OF U-1 RESIDENTIAL DISTRICT TO LOCAL BUSINESS WHEREAS, the subject property is located on the South side of Wilson Mills Road to the East of SOM Center Road and is known as Permanent Parcel Numbers 831-39-010 and 831-39-009 as more particularly described in the Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, this Ordinance has been referred to the Planning and Zoning Commission for report and recommendation per Article III, Sections 12 and 13, of the Mayfield Village Charter; and WHEREAS, said Ordinance has been read at two successive Council meetings, and thereafter a public hearing was held thirty days after the second reading, and prior to the third reading thereof, after having been advertised for thirty days in advance in a newspaper of general circulation throughout the Village, per Article III, Section 13 of the Charter; and WHEREAS, said Ordinance will be referred to the Mayfield Village electors on November 8, 2011 for approval by the voters, per Article III, Section 13 of the Mayfield Village Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The zone map of Mayfield Village, Ohio, established in Section 1153.01 of the Codified Ordinances of Mayfield Village, Ohio, as amended from time to time, is hereby amended by changed the zone classification of the property located and known as Permanent Parcel Numbers 831-39-010 and 831-39-009, and more particularly described in Exhibit "A" attached hereto and incorporated herein by reference such that the property be and is hereby rezoned from its current classification of U-1, Single Family Residential to Local Business. SECTION 2. That the Clerk of Council is hereby and herein directed to certify a copy of this Ordinance to the Cuyahoga County Board of Elections to be placed on the ballot for the election to be held on November 8, 2011. The Clerk shall certify this Ordinance to the Board of Elections no later than sixty days prior to the election date of November 8, 2011 per Mayfield Village Charter Article III, Section 13. SECTION 3. By authority of this Ordinance, the Board of Elections is authorized and directed to place on the ballot for the electors of Mayfield Village, at the election on November 8, 2011, the following question:
