ORDINANCE NO. 2011-28 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN ORDINANCE <br />REVISING THE ZONE MAP OF HAYFIELD VILLAGE <br />SO AS TO AMEND THE USE CLASSIFICATION OF 1028 ACRES OF LAND <br />LOCATED ON THE SOUTH SIDE OF WILSON MILLS ROAD <br />EAST OF SOM CENTER ROAD <br />AND KNOWN AS PERMANENT PARCEL NUMBERS 831-39-010 AND 831-39-009 <br />FROM ITS CURRENT CLASSIFICATION OF <br />U-1 RESIDENTIAL DISTRICT TO LOCAL BUSINESS <br />WHEREAS, the subject property is located on the South side of Wilson Mills Road to the <br />East of SOM Center Road and is known as Permanent Parcel Numbers 831-39-010 and 831-39-009 <br />as more particularly described in the Exhibit "A" attached hereto and incorporated herein by <br />reference; and <br />WHEREAS, this Ordinance has been referred to the Planning and Zoning Commission for <br />report and recommendation per Article III, Sections 12 and 13, of the Mayfield Village Charter; and <br />WHEREAS, said Ordinance has been read at two successive Council meetings, and thereafter <br />a public hearing was held thirty days after the second reading, and prior to the third reading thereof, <br />after having been advertised for thirty days in advance in a newspaper of general circulation <br />throughout the Village, per Article III, Section 13 of the Charter; and <br />WHEREAS, said Ordinance will be referred to the Mayfield Village electors on November 8, <br />2011 for approval by the voters, per Article III, Section 13 of the Mayfield Village Charter. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. The zone map of Mayfield Village, Ohio, established in Section 1153.01 of the <br />Codified Ordinances of Mayfield Village, Ohio, as amended from time to time, is hereby amended <br />by changed the zone classification of the property located and known as Permanent Parcel Numbers <br />831-39-010 and 831-39-009, and more particularly described in Exhibit "A" attached hereto and <br />incorporated herein by reference such that the property be and is hereby rezoned from its current <br />classification of U-1, Single Family Residential to Local Business. <br />SECTION 2. That the Clerk of Council is hereby and herein directed to certify a copy of this <br />Ordinance to the Cuyahoga County Board of Elections to be placed on the ballot for the election to <br />be held on November 8, 2011. The Clerk shall certify this Ordinance to the Board of Elections no <br />later than sixty days prior to the election date of November 8, 2011 per Mayfield Village Charter <br />Article III, Section 13. <br />SECTION 3. By authority of this Ordinance, the Board of Elections is authorized and <br />directed to place on the ballot for the electors of Mayfield Village, at the election on November 8, <br />2011, the following question: <br />
