ORDINANCE NO. 2009-40 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AlV EMERGEleTCY ORDINANCE <br />ACCEPTING THE RELEASE OF A CERTAIN EASEMENT <br />PREVIOUSLY RESERVED FOR STREET AND U'I'ILITY PURPOSES <br />LOCATED ALONG THE PREMISES KNOWN AS <br />WILEY PARK AND ALSO KNOWN AS <br />PERMANENT PARCEI, NO. 831-13-011. <br />WHEREAS, it has been brought to the Village's attention that a certain easement <br />was reserved for street and utility purposes to the benefit of Alvin I. Krenzler, Successor <br />Co-Trustee, along the northerly boundary of Wiley Park; and <br />WHEREAS, upon the authorization and request of Alvin I. Krenzler, successor Co- <br />Trustee, to whom the easer.nent was reserved, Village Council expressly accepts the release <br />of the easement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Council finds that the petition signed by Alvin I. Krenzler, <br />successor Co-Trustee, to whom the easement was expressly reserved for street and utility <br />purposes located along the northerly line of the premises known as 831-13-011 has been <br />presented to Council authorizing their release of the easement and requesting the same to <br />be accepted. <br />SECTION 2. Council further finds that there is good cause for such vacation of <br />said easement for street and utility purposes as requested and that such Release will not be <br />detrimental to the general interest of the Village and shall be made. <br />SECTION 3. That the easement expressly described in the Special Warranty Deed <br />recorded in the Cuyahoga County Recorder's Office at Volume 12312, Page 725 through <br />728, attached hereto and incorporated herein as Exhibit "A" is released. <br />SECTION 4. That the Village Engineer is hereby instructed to prepare a vacation <br />plat evidencing the same and that the Clerk of Council is instructed to endorse upon such <br />plat the action of this Council in vacating said easement. The Release of Easement shall be <br />recorded in the office of the Recorder of Cuyahoga County, Ohio.
