ORDINANCE NO. 2009-50 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CONFIRMING THE APPOINTMENT OF SPECIAL COUNSEL <br />TO REPRESENT THE VILLAGE <br />IN UPCOMING POLICE AND FIRE NEGOTIATIONS <br />AND ESTABLISHING THE TERMS, CONDITIONS, AND <br />COMPENSATION OF SUCH APPOINTMENT. <br />WHEREAS, the Mayor has appointed David J. Matty, as special counsel, <br />pursuant to Article V, Section 4 of the Village's Charter; and <br />WBEREAS, Council deems it necessary and in the best interest of the health, <br />safety and welfare of all Village residents to confirm this appoiritment and establish the <br />terms, conditions and compensation for David J. Matty, as special counsel to handle <br />labor negotiations with the Police and Fire Unions. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF <br />MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor's appointment of David J. Matty, as special counsel to <br />handle the labor negotiations with the Police and Fire Unions for the remaining part of <br />2009 and, if necessary in 2010, is hereby confirmed effective immediately, subject to all <br />applicable Village Ordinances and to the terms, conditions and compensation <br />hereinafter established and in accordance with the engagement letter attached hereto and <br />incorporated herein as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio <br />Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio.
