--- ORDINANCE NO. 2003-01 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AMENDING SECTION 149.02(a)(2) OF THE CODIFIED ORDINANCES <br />TO PROVIDE FOR SIMULTANEOUS EXPIRATION OF <br />ALL SPECfAL USE PERMITS <br />WHEREAS, the Building Commissioner has requested a simultaneous expiration <br />date for all Special Use Permits for the purpose of more efficient monitoring of same; and <br />WHEREAS, Council has determined that such imposition will make the Code more <br />efficient and enforceable. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 1149.02(a)(2) of the Codified Ordinances is hereby and <br />herein amended to read as follows: <br />1149.02 USE DISTRICT EXCEPTIONS <br />(2) Grant in undeveloped sections of the Municipality, temporary and <br />conditional permits but for not more than two year periods for structures and <br />uses that do not conform to the regulations herein prescribed for the use <br />district in which they are to be located. Any such permit granted shall expire <br />on December 31 St of the next even numbered year following the year in which <br />the permit is qranted It will be the responsibility of the permit holder to make <br />application for review and approval of an additional extension no later than <br />November 1 St in the year that expiration is scheduled to occur. <br />(4) Cn the event that Council grants a Special Use Permit under this section, <br />and imposes a time period for review of the permit holder's performance, <br />such review period shall conform with all other Special Use Permits as <br />referred to under Subsection (a)(2) herein above. <br />SECTION 2. The rest and remainder of Section 1149.02 shall remain in full force <br />and effect.
