ORDINANCE NO. 2003- 03 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE ADVERTISEMENT OF BIDS AND SPECIFICATIONS FOR THE FURNISHING AND INSTALLATION OF ALL LABOR, EQUIPMENT, MATERIALS, APPURTENANCES AND INCIDENTALS REQUIRED TO WIDEN AND RECONSTRUCT 2.14 MILES OF S.O.M. CENTER ROAD (S.R. 91) FROM WILSON MILLS ROAD TO WHITE ROAD. WHEREAS, Council deems it necessary and in the best interest of the health, safety and welfare of all Village residents to engage in the widening and reconstruction of S.O.M. Center Road; and WHEREAS, Council wishes to authorize the advertisement of bids and specifications to facilitate such improvement by contracting for the furnishing and installation of all labor, equipment, materials, appurtenances, and incidentals for the widening and reconstruction of 2.14 miles of S.O.M. Center Road, such project shall also include new curbs, sidewalks, bike path, a bikeway underpass structure, storm sewers, signing, pavement markings and traffic signals. NOW, THEREFORE, BE IT ORDAINED BY THAT THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor and Director of Finance are authorized and directed to advertise for bids and issue specifications for the furnishing and installation of all labor, equipment, materials, appurtenances, and incidentals required to widen and reconstruct 2.14 miles of S.O.M. Center Road from Wilson Mills Road to White Road which shall also include the construction of new curbs, sidewalks, a bike path, bikeway underpass structures, storm sewers, signing, pavement markings and traffic signals. SECTION 2. This authorization to advertise the bids and specifications, shall be contingent upon receiving the Ohio Department of Transportation's approval to proceed. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the ?. .
