ORDINANCE NO. 2003-34 <br />t;1 INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING A CONTRACT WITH MODERALLI EXCAVATING <br />FOR THE FURNISHING AND INSTALLATION OF ALL LABOR, EQUIPMENT, <br />MATERIALS, APPURTENANCES AND INCIDENTALS REQUIRED TO PERFORM <br />THE RIPARIAN RESTORATION FOR THE UPPER FORTY AREA <br />WHEREAS, it has been deemed necessary and in the best interest of the health, <br />safety, and welfare of all Village residents to engage in the riparian restoration for the <br />Upper Forty Area; and <br />WHEREAS, pursuant to law bids were advertised by the Village, those bids were <br />received, and it was determined that the bid of Moderalli Excavating was the best bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION1. The Mayor and President of Council are hereby and herein <br />authorized and directed to enter into a Contract with Moderalli Excavating to perform the <br />riparian restoration for the Upper Forty Area, pursuant to the bids and specifications as <br />advertised by the Village referred to as the Base Bid, Contingencies and Alternates, and <br />? pursuant to the Company's bid not to exceed $345,277.58 for the Base Bid, $12,600.00 <br />- for Contingencies and $14,992.50 for Alternates for a total combined contract price of <br />$372,870.08 as received by the Village, which is determined to be the best bid pursuant <br />to the terms and conditions as set forth in these documents which shall be maintained <br />by the Director of Finance. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio <br />Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.
