<br />ORDINANCE NO. 2000- 39 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE ENACTING NEW CHAPTER 946 TO THE CODIFIED <br />ORDINANCES OF THE VILLAGE OF MAYFIELD RELATING TO CUSTOMER <br />SERVICE STANDARDS FOR CABLE TELEVISION SYSTEMS <br />WHEREAS, the Cable Television Negotiating Team for the Cuyahoga County <br />Mayors and Managers Association has proposed that member municipalities enact <br />uniform Cable Television Customer Service Standards, and this Council desires to <br />enact the same as Chapter 946 of the Codified Ordinances of the Village of Mayfield. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. New Chapter 946 shall be added to the Codified Ordinances of the <br />Village of Mayfield, and as enacted shall read as follows: <br />CHAPTER 946: CUSTOMER SERVICE STANDARDS FOR CABLE TELEVISION <br />SYSTEMS <br />Section <br />946.01 Policy <br />946.02 Definitions <br />946.03 Customer service <br />946.04 Customer dissatisfaction with any service <br />946.05 Safety <br />946.99 Penalty <br />§946.01 POLICY. <br />(a) The cable operator should be permitted the option and autonomy to first resolve <br />citizen complaints without delay and interference from the franchising authority. <br />(b) Where a given complaint is not addressed by the cable operator to the citizen's <br />satisfaction, the complaint officer should intervene as indicated in §946.03(g). <br />(c) These standards are intended to be of general application; however, the cable <br />operator shall be relieved of any obligations hereunder if it is unable to perform due to a <br />region-wide natural emergency or in the event of a force majeure condition affecting a <br />significant portion of the franchise area. The cable operator is free to exceed these <br />standards to the benefit of its customers and such shall be considered performance for the <br />purposes of these standards. <br />
