ORDINANCE NO. 2000- 42 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE VILLAGE TO ENTER INTO THE NORTHEAST OHIO PUBLIC <br />ENERGY COUNCIL OF GOVERNMENTS AND THE EXECUTION AND DELIVERY OF <br />THE AGREEMENT ESTABLISHING SUCH COUNCIL, <br />FOR THE PURPOSE OF JOINTLY ESTABLISHING AND IMPLEMENTING <br />AN ELECTRICITY AGGREGATION PROGRAM <br />WHEREAS, this Council previously enacted legislation authorizing the Village to <br />establish an electricity aggregation program pursuant to Section 4928.20, Ohio Revised <br />Code (the "Electricity Aggregation Program"), for the residents, businesses and other <br />electric consumers in the Village and for that purpose, to act jointly with any other municipal <br />corporation, township, county or other political subdivision of the State of Ohio, as <br />permitted by law; and <br />WHEREAS, by joining the Northeast Ohio Public Energy Council, the Village will be <br />able to act jointly with other political subdivisions that have authorized the Electricity <br />Aggregation Program in their respective jurisdictions and thereby maximize the potential <br />benefits of electricity deregulation through group purchasing efforts. <br />'~ NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE <br />THAT: <br />Section 1. This Council finds and determines that it is. in the best interest of the <br />Village, including its residents, businesses and governmental entities, to join the Northeast <br />Ohio Public Energy Council for the purpose of establishing and implementing the <br />Aggregation Program in the Village, pursuant to Ordinance No. 2000-19, authorizing the <br />Aggregation Program previously adopted by this Council. <br />Section 2. The Mayor is hereby authorized to execute and deliver the Agreement <br />establishing the Northeast Ohio Public Energy Council (the "Agreement). The Agreement <br />shall be substantially in the same form, attached as Exhibit A hereto, and on file with the <br />Clerk, subject to such changes, insertions and omissions which are consistent with this <br />Ordinance and are not substantially adverse to the Village and as may be approved by the <br />Mayor, which approval shall be conclusively evidenced by the execution of the Agreement. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />
