' - ORDINANCE NO. 98- 24 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH LAKE COUNTY AS AND FOR STAND-BY AND EMERGENCY WATER SERVICE WHEREAS, Progressive Insurance Company is desirous of a stand-by water system and back-up to the Cleveland water supply in the Village of Mayfield; and WHEREAS, Progressive is willing and will ~ enter into a contract to pay for the installation of any equipment necessary and for the fees to provide for such stand-by service; and WHEREAS, the Agreement between Lake County and the Village of Mayfield is attached hereto and incorporated herein as Exhibit A. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into ari agreement with the Lake County Board of Commissioners in a form comparable to that set forth in Exhibit A, attached hereto and incorporated herein by reference, as and for the providing of stand-by emergency water service. SECTION 2. The Mayor is authorized to enter into this Agreement on the condition that Progressive Insurance Company enters into a collateral agreement indemnifying the Village and obligating itself to pay all installation and fees for the providing of such stand- by water service. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
