' - ORDINANCE NO. 98- 24 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO <br />AN AGREEMENT WITH LAKE COUNTY AS AND <br />FOR STAND-BY AND EMERGENCY WATER SERVICE <br />WHEREAS, Progressive Insurance Company is desirous of a stand-by water <br />system and back-up to the Cleveland water supply in the Village of Mayfield; and <br />WHEREAS, Progressive is willing and will ~ enter into a contract to pay for the <br />installation of any equipment necessary and for the fees to provide for such stand-by <br />service; and <br />WHEREAS, the Agreement between Lake County and the Village of Mayfield is <br />attached hereto and incorporated herein as Exhibit A. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and directed to enter <br />into ari agreement with the Lake County Board of Commissioners in a form comparable to <br />that set forth in Exhibit A, attached hereto and incorporated herein by reference, as and <br />for the providing of stand-by emergency water service. <br />SECTION 2. The Mayor is authorized to enter into this Agreement on the condition <br />that Progressive Insurance Company enters into a collateral agreement indemnifying the <br />Village and obligating itself to pay all installation and fees for the providing of such stand- <br />by water service. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />
