<br />AN EMERGENCY ORDINANCE
<br />TO APPROPRIATE A FEE SIMPLE INTEREST IN AND TO THE PREMISES
<br />KNOWN AS PERMANENT PARCEL NOS. 831-5-27, 831-5-28, 831-5-29,
<br />831-5-30, 831-5-31, 831-5-44, 831-5-45, 831-5-46, 831-5-47, 831-5-48
<br />FOR PUBLIC STREET PURPOSES
<br />WHEREAS, this Council is determined that in the promotion of the health, safety
<br />and welfare of the residents of the Village of MayFeld, it is necessary for the Village to
<br />appropriate for street purposes a fee simple interest in and to the premises known as
<br />,Permanent Parcel Nos. 831-5-27, 831-5-28, 831-5-29, 831-5-30, 831-5-31, 831-5~4,
<br />831-5-45, 831-5-46, 831-5-47, 831-5-48 for public street purposes; and
<br />WHEREAS, on April 20, 1998, this Council passed Emergency Ordinance No.
<br />1998-19 to be given to the owners/persons in possession and persons having an interest
<br />of record in the premises; and
<br />WHEREAS, negotiations to purchase a fee simple interest in the premises have
<br />been had and the Village and the owners/persons in possession and persons having an
<br />interest of record in the premises are unable to agree; and
<br />-- WHEREAS, the Village desires to take the property bythe QuickTake Procedures
<br />under Ohio Revised Code Section 163.06, for the reason that the access street is
<br />immediately needed for the opening up of the interior roadways for development going
<br />on at the current time, and that pursuant to Ohio Revised Code Section 163.06, the
<br />Petition filed with the Probate Court should include a statement of the value of the
<br />property being appropriated, togetherwith damages, if any, to the residue as determined
<br />by the Village; and
<br />WHEREAS, the Finance Director is authorized to deposit the appraisal funds for
<br />the value of the property, in the amount of $110,000.00, to be filed along with the Petition
<br />with the Probate Court.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE
<br />OF MAYFIELD, COUNTY OF CUYAHOGA AND STATE OF OHIO, THAT:
<br />SECTION 1. That a fee simple interest in the premises known as Permanent
<br />Parcel Nos. 831-5-27, 831-5-28, 831-5-29, 831-5-30, 831-5-31, 831-5-44, 831-5-45,
<br />831-5-46, 831-5-47, 831-5-48, as further described in the attached Exhibit A,
<br />incorporated herein by reference as if fully rewritten, is appropriated for the creation of
<br />a public street pursuant to the Constitution and the laws of the State of Ohio.
