ORDINANCE NO. 98- 31 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING THE PURCHASE OF 7.35 ACRES OF VACANT LAND ALONG WHITE ROAD FROM CAPCO ENTERPRISES CO. WHEREAS, the Village is desirous of acquiring certain property for potential access to the Parkview Golf Course property which Council deems to be in the best interests of all Village residents; and WHEREAS, the property known as Permanent Parcel No. 831-04-001, 7.35 acres of vacant land which the Village has appraised and determined the fair market value to be $140,000.00. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor and Director of Finance, and Director of Law are hereby and herein authorized and directed to enter into a Purchase Agreement with CAPCO Enterprises Co. and to acquire the property known as Permanent Parcel No. 831-04-001, and also known as 7.35 acres of vacant land along White Road, in the Village of Mayfield, for an amount not to exceed $140,000.00, and upon the terms and conditions set forth in Exhibit A, attached hereto and incorporated herein by reference. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
