ORDINANCE NO. 98- 31 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE PURCHASE OF 7.35 ACRES OF <br />VACANT LAND ALONG WHITE ROAD <br />FROM CAPCO ENTERPRISES CO. <br />WHEREAS, the Village is desirous of acquiring certain property for potential access <br />to the Parkview Golf Course property which Council deems to be in the best interests of <br />all Village residents; and <br />WHEREAS, the property known as Permanent Parcel No. 831-04-001, 7.35 acres <br />of vacant land which the Village has appraised and determined the fair market value to be <br />$140,000.00. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor and Director of Finance, and Director of Law are hereby <br />and herein authorized and directed to enter into a Purchase Agreement with CAPCO <br />Enterprises Co. and to acquire the property known as Permanent Parcel No. 831-04-001, <br />and also known as 7.35 acres of vacant land along White Road, in the Village of Mayfield, <br />for an amount not to exceed $140,000.00, and upon the terms and conditions set forth in <br />Exhibit A, attached hereto and incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio.
