•- r° See Ord. 98-10 re original ~~ ', development agreement -- ORDINANCE NO. 98- 33 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AN AMENDMENT TO TH E DEVELOPMENT AGREEMENT ENTERED INTO WITH PROGRESSIVE CASUALTY INSURANCE COMPANY WHEREAS, a Development Agreement was entered into with the Progressive Casualty Insurance Company on March 27, 1998; and WHEREAS, it is the desire of Council to amend the Development Agreement so as to require Progressive to pay an assessment for one-half of the North Chagrin Commons Boulevard between White Road and the southerly end of the former golf course property. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the amendment to the Development Agreement, attached hereto and incorporated herein as Exhibit A, so as to require Progressive to pay an assessment for one-half of the North Chagrin Commons Boulevard between White Road and the southerly property line of the former golf course, is hereby and herein approved and the Mayor is authorized to enter into said agreement. SECTION 2. The Council. finds and determines that .all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations ofthis-Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
