•- r° See Ord. 98-10 re original <br />~~ ', development agreement <br />-- ORDINANCE NO. 98- 33 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AMENDMENT TO TH E <br />DEVELOPMENT AGREEMENT ENTERED INTO <br />WITH PROGRESSIVE CASUALTY INSURANCE COMPANY <br />WHEREAS, a Development Agreement was entered into with the Progressive <br />Casualty Insurance Company on March 27, 1998; and <br />WHEREAS, it is the desire of Council to amend the Development Agreement so as <br />to require Progressive to pay an assessment for one-half of the North Chagrin Commons <br />Boulevard between White Road and the southerly end of the former golf course property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the amendment to the Development Agreement, attached hereto <br />and incorporated herein as Exhibit A, so as to require Progressive to pay an assessment <br />for one-half of the North Chagrin Commons Boulevard between White Road and the <br />southerly property line of the former golf course, is hereby and herein approved and the <br />Mayor is authorized to enter into said agreement. <br />SECTION 2. The Council. finds and determines that .all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations ofthis-Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio.
