ORDINANCE NO. 98- 36 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />ACCEPTING THE PROPOSAL OF <br />FIRST ENERGY REGARDING THE NIGHTVISION <br />LIGHTING SERVICES FOR THE ILLUMINATION OF <br />PORTIONS OF NORTH CHAGRIN COMMONS <br />WHEREAS, NightVision is an outdoor lighting service offered to augment the <br />standard street and area lighting program from the Cleveland Electric Illuminating <br />Company; and <br />WHEREAS, the goal of this service is to allow CEI customers to obtain the most <br />cost effective, durable, and high quality lighting systems to meet performance and <br />budgetary requirements of each project; and <br />WHEREAS, Nighti/ision has made a proposal that the illumination of designated <br />portions of North Chagrin Commons and Village Council deems the acceptance of this <br />proposal to be in the best interest of the health, safety, and welfare of all Village residents. <br />NOW, THEREFORE, BE iT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the .proposal of First Energy with regards to the NightVision <br />program for the illumination of portions of the North Chagrin Commons, which is attached <br />as Exhibit A, is hereby accepted. <br />SECTION 2. That the Director of Finance is authorized and directed to make <br />appropriate and timely payments from the appropriate fund relative to the total cost of the <br />proposal, not to exceed Three Hundred Forty-One Thousand Six Hundred Dollars <br />($341,600.00). <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requires-gents of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />
