RESOLUTION N0.2008-17 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY RESOLUTION IN SUPPORT OF AND ENCOURAGING HOUSE BILL 528 TO MAKE IT UNLAWFUL FOR HOME IMPROVEMENT STORES TO SELL "WATER KEYS" TO ANYONE OTHER THAN A REGISTERED PLUMBER. WHEREAS, at the request of City of East Cleveland Mayor, Eric J. Brewer, State Representative Eugene Miller introduced House Bi11528; and WHEREAS, House Bi11528 will make it unlawful for home improvement stores to sell "water keys" that are used by municipalities to connect and disconnect water valves at the curb to anyone other than a registered plumber; and WHEREAS, at this time, without House Bi11528, water keys are being sold by home improvement stores to anyone seeking to buy one for $14.95 and are being used by these individuals to reconnect their service despite having delinquent accounts; and WHEREAS, the unlawful use of water keys atone point found East Cleveland losing more than 20 percent of its water to theft at a cost in excess of $1 million dollars; and WHEREAS, these water losses effect all water and sewer rates in the vast majority of municipalities in Cuyahoga County that have direct service agreements with the City of Cleveland to supply them with water; and WHEREAS, the Village deems it in the best interest of all residents to support House Bi11528. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Council of Mayfield Village hereby and herein expresses its support of House Bi11528. SECTION 2. Council further directs the Clerk of Council to send a certified copy of this Emergency Resolution to Ohio Senator Timothy J. Grendell and House Representative Matthew J. Dolan. SECTION 3. The Council finds and determines that all formal actions of the Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
