RESOLUTION N0.2008-17 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION IN SUPPORT OF <br />AND ENCOURAGING HOUSE BILL 528 <br />TO MAKE IT UNLAWFUL FOR HOME IMPROVEMENT STORES <br />TO SELL "WATER KEYS" TO ANYONE <br />OTHER THAN A REGISTERED PLUMBER. <br />WHEREAS, at the request of City of East Cleveland Mayor, Eric J. Brewer, State <br />Representative Eugene Miller introduced House Bi11528; and <br />WHEREAS, House Bi11528 will make it unlawful for home improvement stores to <br />sell "water keys" that are used by municipalities to connect and disconnect water valves at <br />the curb to anyone other than a registered plumber; and <br />WHEREAS, at this time, without House Bi11528, water keys are being sold by home <br />improvement stores to anyone seeking to buy one for $14.95 and are being used by these <br />individuals to reconnect their service despite having delinquent accounts; and <br />WHEREAS, the unlawful use of water keys atone point found East Cleveland losing <br />more than 20 percent of its water to theft at a cost in excess of $1 million dollars; and <br />WHEREAS, these water losses effect all water and sewer rates in the vast majority of <br />municipalities in Cuyahoga County that have direct service agreements with the City of <br />Cleveland to supply them with water; and <br />WHEREAS, the Village deems it in the best interest of all residents to support House <br />Bi11528. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Council of Mayfield Village hereby and herein expresses its <br />support of House Bi11528. <br />SECTION 2. Council further directs the Clerk of Council to send a certified copy of <br />this Emergency Resolution to Ohio Senator Timothy J. Grendell and House Representative <br />Matthew J. Dolan. <br />SECTION 3. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />
