ORDINANCE N0.2015-25 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND PRESIDENT OF COUNCIL TO ENTER INTO AN EASEMENT AGREEMENT BETWEEN HAYFIELD VILLAGE, OHIO, AND THE HAYFIELD CITY SCHOOL DISTRICT WHEREAS, the Mayfield City School District ("District") is the owner of certain real property in Mayfield Village, Ohio that abuts certain real property owned and utilized by the Village on which the Village has and continues to operate a Community Room; and WHEREAS, the Village has undertaken the project known as the Mayfield Village Community Room Project for the construction of and improvements to the Community Room and portions of the surrounding real property; and WHEREAS, the District desires to provide to the Village an easement across a portion of the District's Property for purposes of pedestrian and vehicular ingress and egress, parking, maintenance, temporary and/or permanent improvements on, over, and .under a portion of the District's property, including access by the Village as well as the general public to assist in continuing to provide community, recreational and educational opportunities. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Council authorizes the Mayor and President of Council to enter into the Easement Agreement with the Mayfield City School District, a copy which agreement is attached as Exhibit "A" and incorporated by reference, for the purpose of providing pedestrian and vehicular ingress and egress, parking, maintenance, temporary and/or permanent improvements on, over, and under a portion of the District's real property, including access by the Village as well as the general public to assist in continuing to provide community, recreational and educational opportunities. ~, SECTION 2. Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio.
