ORDINANCE N0.2015-25 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO AN EASEMENT AGREEMENT BETWEEN <br />HAYFIELD VILLAGE, OHIO, AND THE HAYFIELD CITY SCHOOL DISTRICT <br />WHEREAS, the Mayfield City School District ("District") is the owner of certain real <br />property in Mayfield Village, Ohio that abuts certain real property owned and utilized by the <br />Village on which the Village has and continues to operate a Community Room; and <br />WHEREAS, the Village has undertaken the project known as the Mayfield Village <br />Community Room Project for the construction of and improvements to the Community Room <br />and portions of the surrounding real property; and <br />WHEREAS, the District desires to provide to the Village an easement across a portion of <br />the District's Property for purposes of pedestrian and vehicular ingress and egress, parking, <br />maintenance, temporary and/or permanent improvements on, over, and .under a portion of the <br />District's property, including access by the Village as well as the general public to assist in <br />continuing to provide community, recreational and educational opportunities. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Council authorizes the Mayor and President of Council to enter into the <br />Easement Agreement with the Mayfield City School District, a copy which agreement is attached <br />as Exhibit "A" and incorporated by reference, for the purpose of providing pedestrian and <br />vehicular ingress and egress, parking, maintenance, temporary and/or permanent improvements <br />on, over, and under a portion of the District's real property, including access by the Village as <br />well as the general public to assist in continuing to provide community, recreational and <br />educational opportunities. ~, <br />SECTION 2. Council finds and determines that all formal actions of this Council relating <br />to the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield Village, <br />Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />
