ORDINANCE N0.2015-28 <br />-- INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT WITH GATES MILLS, OHIO <br />FOR FIRE PROTECTION SERVICES <br />FOR CALENDAR YEARS 2016, 2017, 2018, 2019, AND 2020. <br />WHEREAS, Mayfield Village and Gates Mills are both municipal corporations <br />established pursuant to the Constitution and the laws of the State of Ohio; and <br />WHEREAS, Section 9.60 of the Ohio Revised Code provides that municipal <br />corporations may contract with each other for fire protection services, including but not limited <br />to ambulance and emergency medical service; and <br />WHEREAS, in 2012, Mayfield Village entered into an agreement with Gates Mills <br />whereby Mayfield Village provided fire protection services, including ambulance and EMS <br />services, to Gates Mills for calendar years 2012, 2014, and 2015, with said agreement <br />terminating on December 31, 2015; and <br />WHEREAS, at that time the Mayor and Council of Mayfield Village. determined that it <br />was in the best interest of the Village to enter into the contract for such services; and <br />WHEREAS, it is in the best interest of Mayfield Village to continue such services <br />pursuant to an new agreement for fire protection services to be provided by Mayfield Village to <br />Gates Mills for calendar years 2016, 2017, 2018, 2019, and 2020. <br />NOW, THEREFORE, SE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Council authorizes Mayor and President of Council to enter into an Agreement <br />with Gates Mills, Ohio, a copy of which is attached as Exhibit "A" and incorporated by reference, for <br />the purpose of providing fire protection services; including ambulance and EMS services, to Gates <br />Mills pursuant to the terms and conditions set forth in the Agreement. <br />SECTION 2. Council finds and determines that all formal actions of this Council relating to <br />the adoption of this Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />
