ORDINANCE N0.2015-28 -- INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AN AGREEMENT WITH GATES MILLS, OHIO FOR FIRE PROTECTION SERVICES FOR CALENDAR YEARS 2016, 2017, 2018, 2019, AND 2020. WHEREAS, Mayfield Village and Gates Mills are both municipal corporations established pursuant to the Constitution and the laws of the State of Ohio; and WHEREAS, Section 9.60 of the Ohio Revised Code provides that municipal corporations may contract with each other for fire protection services, including but not limited to ambulance and emergency medical service; and WHEREAS, in 2012, Mayfield Village entered into an agreement with Gates Mills whereby Mayfield Village provided fire protection services, including ambulance and EMS services, to Gates Mills for calendar years 2012, 2014, and 2015, with said agreement terminating on December 31, 2015; and WHEREAS, at that time the Mayor and Council of Mayfield Village. determined that it was in the best interest of the Village to enter into the contract for such services; and WHEREAS, it is in the best interest of Mayfield Village to continue such services pursuant to an new agreement for fire protection services to be provided by Mayfield Village to Gates Mills for calendar years 2016, 2017, 2018, 2019, and 2020. NOW, THEREFORE, SE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Council authorizes Mayor and President of Council to enter into an Agreement with Gates Mills, Ohio, a copy of which is attached as Exhibit "A" and incorporated by reference, for the purpose of providing fire protection services; including ambulance and EMS services, to Gates Mills pursuant to the terms and conditions set forth in the Agreement. SECTION 2. Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
