ORDINANCE N0.2016-31 <br />INTRODUCED BY: Mayor Bodnar and Council as a Whole <br />AN ORDINANCE AMENDING <br />CHAPTER 1105 OF THE CODIFIED ORDINANCES <br />RELATING TO THE BOARD OF ZONING APPEALS <br />AND THE GRANTING OF "USE" VARIANCES PURSUANT TO VOTER <br />APPROVED AMENDMENTS TO THE CHARTER <br />WHEREAS, the voters of the Village of Mayfield at the general election in <br />November 2015 approved a Charter Review Commission recommendation for amendment <br />to the Charter, Article V, Section 12, allowing use variances to be granted by the Board of <br />Zoning Appeals in nonresidential districts; and <br />WHEREAS, Chapter 1105 of the Codified Ordinances sets forth the guidelines <br />adopted by Council for the Board of Zoning Appeals in the granting of variances and the <br />performance of their other duties which require amendment as a result of the Charter changes <br />approved by the voters. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, <br />Ohio, that: <br />SECTION 1. That Chapter 1105 of the Codified Ordinances, specifically Section <br />1105.02, is hereby and herein amended, pursuant to the Charter amendments approved by the <br />voters of the Village of Mayfield to read as set forth in Exhibit "A" attached hereto and <br />incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />
