ORDINANCE N0.2016-31 INTRODUCED BY: Mayor Bodnar and Council as a Whole AN ORDINANCE AMENDING CHAPTER 1105 OF THE CODIFIED ORDINANCES RELATING TO THE BOARD OF ZONING APPEALS AND THE GRANTING OF "USE" VARIANCES PURSUANT TO VOTER APPROVED AMENDMENTS TO THE CHARTER WHEREAS, the voters of the Village of Mayfield at the general election in November 2015 approved a Charter Review Commission recommendation for amendment to the Charter, Article V, Section 12, allowing use variances to be granted by the Board of Zoning Appeals in nonresidential districts; and WHEREAS, Chapter 1105 of the Codified Ordinances sets forth the guidelines adopted by Council for the Board of Zoning Appeals in the granting of variances and the performance of their other duties which require amendment as a result of the Charter changes approved by the voters. NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, Ohio, that: SECTION 1. That Chapter 1105 of the Codified Ordinances, specifically Section 1105.02, is hereby and herein amended, pursuant to the Charter amendments approved by the voters of the Village of Mayfield to read as set forth in Exhibit "A" attached hereto and incorporated herein by reference. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
